Judicial review hears cattle grids will be placed at all South Kerry Greenway crossings

A judicial review has heard cattle grids would be placed at all 32 road crossings along the South Kerry Greenway.

The Greenway Information Group and farmer James Clifford along with environmentalist Peter Sweetman are challenging the decision of An Bord Pleanála granting permission to Kerry County Council for the South Kerry Greenway and the accompanying CPO.

The High Court heard cattle grids will be placed at 32 crossings across private roads along the South Kerry Greenway; 16 crossings are agricultural access roads with some crossings a combination of residential and agricultural.

The Greenway Information Group claims the board's requirement for cattle grids at all crossings departed from planning Inspector Karla McBride's recommendation and was made without environmental assessment.

The court heard the board had taken the decision on traffic safety grounds and in response to what it found were legitimate concerns raised by the Greenway Information Group about the risk of animals straying onto the greenway.

Mr Justice Richard Humphreys asked how the cattle grids will impact on cyclist's experience of the greenway.

Senior Counsel for Kerry County Council, Esmonde Keane said the local authority didn't want cattle grids at every crossing but accepted the board's decision.

He said there will be signage at all crossings advising cyclists to dismount and use the gate; he said some may choose to cycle over the grid.

Mr Keane also agreed with Senior Counsel for An Bord Pleanála, Brian Foley that a derogation licence doesn't need to be in place prior to granting permission and that a separate report is not required by the board when considering whether to confirm a Compulsory Purchase Order.

And in some breaking news proceedings in the judicial review have concluded.

A decision to whether or not to quash a decision by An Bord Pleanála to grant permission for the scheme and to confirm the CPO will be made in due course.
