Kerry County Council has withdrawn its legal action against a Kerry TD.
The local authority had sought to force Independent deputy Danny Healy-Rae to remove a sign over his bar on Main Street, Kilgarvan. It was alleged the sign breached planning laws.
The council had sought legal action against a sign over Healy-Rae’s bar in Kilgarvan. The application, which was under the Planning and Development Act, came before the Civil Circuit Court in Killarney again today, having been adjourned in May.
Independent deputy Danny Healy-Rae says the issue was over whether the sign had permission to be erected, however, he says a sign of some nature had been there for decades, going back to when his father was a member of Kerry County Council. He says he’s delighted the local authority withdrew the action, adding it was a weight on his shoulders recently.
Deputy Danny Healy-Rae thanks his legal team, supporters and neighbours, some of whom he says were prepared to provide testimony to the court.
A similar action by the council against his brother Micheal Healy-Rae failed earlier this year, after the court ruled the local authority had acted too late and brought proceedings beyond the seven-year cut off period.
